These Terms & Conditions ("Terms") govern your booking and participation in any trek, tour, experience, or journey ("Trip") operated by Patan Adventures ("we," "us," "our"). By submitting a booking, paying a deposit, or participating in a Trip, you ("Guest," "you") agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not book or join a Patan Adventures Trip.

By using this Site or engaging our services, you agree to the practices described in this policy. If you do not agree, please do not use the Site or share personal information with us.

1. Bookings & Payment

  • A booking is confirmed only once a deposit (or full payment, where required) has been received and we have issued a written confirmation.
  • The remaining balance is due no later than 30 days before the Trip start date, unless otherwise agreed in writing.
  • We reserve the right to cancel a booking if full payment is not received by the due date.
  • Prices are quoted in US Dollars and may be subject to change prior to booking confirmation due to exchange rates, permit fees, or third-party costs beyond our control. Once confirmed, your price is locked in.

2. Cancellations & Refunds

By the Guest:

  • Cancellations must be submitted in writing (email is acceptable).
  • Refunds are calculated based on how far in advance notice is given:
    • 60+ days before departure: 80 %
    • 30–60 days before departure: 50 %
    • Less than 30 days before departure: non-refundable
  • Deposits are generally non-refundable, as they cover permits, guide bookings, and accommodation holds made on your behalf.

 

By Patan Adventures:

    • If we cancel a Trip (e.g., due to insufficient group size, safety conditions, or operational reasons), you will be offered a full refund or the option to transfer to an alternative date or Trip.
    • We are not responsible for incidental costs (flights, visas, gear) incurred by the Guest in preparation for a cancelled Trip.

3. Flexible Booking Policy

We understand travel plans change. Guests may reschedule a confirmed booking to a new date within 3 months of the original Trip at no additional fee, subject to availability, provided the request is made at least 30 days before the original departure.

4. Health, Fitness & Assumption of Risk

  • Treks, tours, and adventure events offered by Patan Adventures may involve high altitude, physically demanding terrain, and remote locations with limited access to medical care.
  • Guests are responsible for ensuring they are medically fit to participate and should consult a physician before booking, particularly for high-altitude treks.
  • By participating, you acknowledge and accept the inherent risks of adventure travel, including but not limited to altitude sickness, injury, adverse weather, and travel delays.
  • Guests must disclose any relevant medical conditions at the time of booking.

5. Travel Insurance

Comprehensive travel insurance — covering trip cancellation, emergency medical treatment, and emergency evacuation (including helicopter evacuation for high-altitude treks) — is mandatory for all Guests. Proof of insurance may be requested prior to departure. Patan Adventures is not liable for costs arising from a Guest’s failure to obtain adequate coverage.

6. Itinerary Changes

  • Itineraries are planned carefully but may be altered due to weather, road or trail conditions, political circumstances, flight delays (particularly to/from mountain airstrips), or safety judgment by our guides on the ground.
  • Guide and trip leader decisions regarding route changes, turnbacks, or early descent for safety reasons are final.
  • We will make reasonable efforts to minimize disruption and offer comparable alternatives where possible.

7. Permits, Documents & Local Regulations

  • Guests are responsible for ensuring they hold valid passports, visas, and any personal travel documentation required for entry into Nepal.
  • Patan Adventures will arrange required trekking permits and park fees as part of the standard Trip inclusions, unless stated otherwise.

8. Guest Conduct

Guests are expected to treat guides, staff, fellow travelers, local communities, and the environment with respect. Patan Adventures reserves the right to remove any Guest from a Trip, without refund, whose conduct endangers themselves, others, or the reputation of the communities we work in.

9. Limitation of Liability

To the extent permitted by applicable law, Patan Adventures, its guides, and its partners are not liable for injury, loss, delay, or damage arising from circumstances beyond our reasonable control, including but not limited to natural events, political instability, third-party service failures, or Guest non-disclosure of medical conditions. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Force Majeure

We are not liable for failure to perform any obligation under these Terms where such failure results from circumstances beyond our reasonable control, including natural disasters, extreme weather, pandemics, government action, or civil unrest.

11. Photography & Media

Patan Adventures may capture photos or video during Trips for marketing purposes. Guests who do not wish to be featured should notify their guide in writing prior to the Trip.

12. Governing Law

These Terms are governed by the laws of Nepal. Any disputes arising from a Trip or booking shall be subject to the jurisdiction of the courts of Nepal, unless otherwise required by applicable consumer protection law.
